Supreme Court Upholds State Bans on Transgenders in Girls’ & Women’s Skateboarding & Other Sports

The United States Supreme Court has ruled that states can prohibit transgender athletes from competing on girls' and women's teams, a decision that could have an impact across many activities, including skateboarding.

While the cases before the court were not about skateboarding, the decision may influence how school competitions and other events handle eligibility in the future.

The ruling came from two closely watched cases involving laws in West Virginia and Idaho. In a majority opinion written by Justice Brett Kavanaugh, the Court said states are allowed to base eligibility for girls' and women's teams on biological sex under Title IX and the Equal Protection Clause of the Constitution.

According to the opinion, states may continue to organize girls' and women's athletic competitions for biological females without violating federal law. The Court also said that neither the Constitution nor Title IX requires schools to change that approach.

Not every justice agreed with the outcome. Justice Sonia Sotomayor, joined by the other liberal justices on the Equal Protection issue, argued that the Court overlooked important facts surrounding the individual athletes involved. She wrote that the ruling leaves little room to consider personal circumstances, including the transgender student at the center of the West Virginia case, Becky Pepper Jackson.

The decision allows similar laws in 27 states to remain in effect. Over the last several years, those states adopted legislation limiting participation in girls' and women's school athletics to athletes assigned female at birth. Last year, President Donald Trump also signed an executive order directing federally funded educational programs to restrict transgender girls and women from competing on teams that match their gender identity.

The Court also pointed out that its earlier decision protecting LGBTQ employees from workplace discrimination under Title VII does not apply in the same way to Title IX cases involving school athletics. Justice Kavanaugh wrote that employment law and athletic competition involve different legal questions, so the Court did not believe the previous ruling controlled these cases.

One of the cases centered on West Virginia's Save Women's Sports Act, passed in 2021. The law requires school athletic teams to be separated according to biological sex at birth. Becky Pepper Jackson challenged the law before it took effect after seeking to compete on her school's girls cross country and track teams. Although a federal appeals court ruled in her favor last year, the Supreme Court reversed that outcome and upheld the state law.

Lawyers representing Pepper Jackson argued that there are very few transgender athletes affected by these laws and that medical treatment can eliminate any competitive advantage. State officials responded that the law is intended to preserve girls' and women's athletic competition based on biological sex. The Supreme Court ultimately agreed with the state's position.

The second case involved Idaho, which became the first state to adopt a law restricting transgender athletes from girls' and women's school teams. Lindsay Hecox challenged the law after attempting to compete on the women's track and cross country teams at Boise State University. Although lower courts questioned the law's constitutionality, the Supreme Court upheld Idaho's restrictions alongside the West Virginia case.

Even though the ruling focused on school athletics, conversations are already expanding into other communities, including skateboarding. The activity has grown into one of the most welcoming spaces for LGBTQIA+ skaters, with many local skate crews, events, brands, and organizers working to create places where everyone feels accepted regardless of gender identity or sexual orientation.

Many LGBTQIA+ skate sessions and community events have become an important part of modern skateboarding over the past several years. They have given transgender skaters, queer skaters, and allies opportunities to meet, skate together, and build supportive communities that extend beyond contests and competitions. Those gatherings are expected to continue regardless of changes involving school athletics.

At the same time, the Supreme Court's decision is likely to bring new conversations about eligibility, inclusion, and fairness whenever organized skateboarding competitions fall under state rules or educational programs. Different organizations may respond in different ways depending on where events are held and which policies apply.

For many people within skateboarding, the discussion is about more than competition. It also involves community, respect, and making sure everyone has a place to enjoy skateboarding. As the legal landscape continues to change across the United States, LGBTQIA+ skaters and their allies will likely remain part of those conversations while continuing to build welcoming spaces both inside and outside competitive events.
